Don't use structured data that would be considered misleading

Google will hit you with a penalty if you do. Every advantage you can get while sticking to Google's guidelines is important.

How can you test to see if markup is used correctly?

One simple and cheap test is to use Google's structured data testing tool. Also do a cursory review and make sure the basics look good like business address of hours of operation.

You need to make sure you are not generating sitemaps for content that you don't want to show up (read up on no indexing if you don't know what I'm talking about).
