here is what wikipedia tells us about it https://en.wikipedia.org/wiki/Trademark

actually, before giving something a name you should check whether it has not been already taken by someone else. If you have the name that already exists and it is a registered mark - you may have authorship problems with a person who obtain that name before you and registered it.
